This is a Federal Court case where the applicant is seeking an adjournment of the hearing to enable him to prepare his case. The Judge is discussing what can be put before him in evidence.
Transcript of part of the discussion with the practitioner reads:
His Honour You see, I am worried about this business of evidence. You keep coming back to it. What I am trying to explain to you is evidence that is directing to persuading me that the PSR committee got it wrong, I can't - I can't even look at it. I can't even start delving into it. If you want to go away for the purpose of putting all these patients on affidavit and putting all your files and everything before me to persuade me that the PSR committee took the wrong view about what you said, forget it.
You will be just incurring even more debt from the respondents. Because the more you do, the more you make them read, the more the hourly rates tick over and up go the costs. And they are pretty big now, given the way - given the history of these cases. They are pretty big costs. You won't like it when you get the bill if you lose. I think you really want to think about whether you want to go ahead with these cases.
